Litigation
The attorneys of our Firm collectively have
a rich and varied experience in State and Federal courts
and administrative agencies which regularly benefits our clients. The
type of litigation we handle closely tracks with the areas of our Firm's
transactional focus. Specifically,
we are regularly involved in probate court will and trust contests, corporate
and commercial matters, including business dissolutions, shareholder and
partner disputes, contract disputes and real estate "quiet title" and
land use actions.
Perhaps our strongest offering arises from our
transactional experience and an acumen outside of litigation. A great many litigators lack independent transactional expertise
in substantive litigation matters. We
have been able to combine competence in the courtroom with a broader transactional
competence in the actual subject matter in dispute. This
has allowed us to have a better grasp of the subject and greater facility
in achieving out of court settlements.
A key tenet of our philosophy is that when a
Court case goes all the way to a trial on the merits, all of the parties
involved have already "lost" something. Even
the prevailing litigant is often still something of a "casualty." We
work hard to place our client in the position of being the clear and impending
victor in the eyes of the Court, so that trial may be avoided whenever
possible.
