At Laboe & Tasker we have extensive experience developing estate plans of all types for people from every walk of life and circumstance. Laboe & Tasker occupies a unique niche; unlike most estate planning attorneys generally, we are also Elder Law Attorneys. As such, we are keenly aware of and tuned into Medicaid eligibility rules and the impact that they have on our clients. Long-term care is breathtakingly expensive, but there is much that can be done to plan successfully for that burden.

We are also probate court litigators and we bring our experience litigating contested probate to our estate planning clients by advising them on how to avoid future disputes between their heirs. Most importantly as relates to the creation of new (or newly amended) Wills and Trusts are relatively recent changes in New Hampshire law that allows a testator/settlor to have their Will or Trust pre-approved by the probate court during their lifetime.

PROBATE & TRUST ADMINISTRATION

Probate: If you have been named executor (in some states known as a personal representative) of a will, you have many fiduciary duties of which you may not be aware. Laboe & Tasker represents clients throughout the probate and estate administration process. We help clients through what can initially seem like a daunting legal and financial process in Probate Court.

Trust: Laboe & Tasker, PLLC assists clients with evaluating the various options for administering estates and trusts. Every situation requires a unique strategy to minimize estate taxes and liability owed to creditors, while maximizing the value of the assets. In some cases, probating the will is the wrong approach. Laboe & Tasker works with the family to develop a plan to minimize the liability risks to the trustee while maximizing the distributions to the heirs. In addition, we provide postmortem strategies for families to minimize estate and income taxes.

We help corporate and individual trustees find the right solutions across a range of trust administration problems including:

REAL ESTATE

Our team is equipped to handle a wide range of residential and commercial real estate transactions and resolve title defects discovered in land conveyancing generally.

Laboe & Tasker represents clients in a wide variety of real estate transactions and litigation matters. We frequently advise clients on: the purchase and sale of commercial and residential real estate; the leasing of commercial and residential real estate; public and private financing alternatives, and the resolution of boundary and title disputes more generally. We customarily handle private closings that sometimes involve neither a broker nor a bank.

In addition to our transactional experience, Laboe & Tasker represents property owners in litigation matters such as evictions, quiet title and declaratory judgment cases, as well as non-judicial foreclosures.

LITIGATION

Lawyers at the Firm have extensive experience in New Hampshire State Courts at every level, including before the New Hampshire Supreme Court. Further, our litigation experience includes administrative appeals before agency tribunals and administrative law judges. As a rule, the Firm tends to limit the subject matter of its litigation to those areas in which it  has the greatest depth of experience, transactionally. Those subject areas with the greatest litigation interest to the Firm are contested probate and trust administration matters (typically intra-family), real estate, financial exploitation and undue influence cases, Medicaid eligibility, closely held business disputes, and select taxation issues. The Firm seeks to guide clients towards successful alternative dispute resolution outside of the courtroom wherever possible.
